The Impact of Builders Risk Coverage on Contruction Defect Claims

This presentation is focused on the application of Builders Risk coverage to damage of construction projects resulting from various causes, and how to implement proper risk management practices and mitigate loss from the outset of construction and throughout the contract drafting phase. It will include a discussion of the Owner’s versus the General Contractor’s perspective when purchasing a Builder’s Risk policy and how the rights and duties of each party should be set forth in the construction contract to ensure optimate risk transfer and the ability to receive benefits under the policy. In addition, there will be a discussion about deductible-shifting provisions and other key provisions to be aware of when considering Builders Risk coverage.
At the end of the presentation, participants will have a comprehensive understanding of the interplay between optimal risk transfer in construction contracts and Builders Risk coverage.
