COVID-19 has presented new and substantial issues managing risks, relationships, and contract performance. It has forced franchisors and franchisees to scrutinize the insurance and force majeure provisions of their franchise agreements, lease, supply chain contracts, and to evaluate whether certain contractual rights and remedies should be temporarily waived or deferred. This session will provide an overview of the fundamentals of insurance to help franchise systems review insurable reviews, identify available products, and obtain comprehensive coverage. This session will also review contractual force majeure provisions in the franchising context, including lessons learned from COVID-19 regarding draft and enforcement.
