Environmental issues have been plaguing real estate and development projects for years, resulting in delays, cost overruns, third party exposures, claims, and often times, litigation. As new development is focused on the inner city, waterfront properties, and other historic industrial sites, this trend is not going to decrease anytime soon. Properties built in the late 1960’s and 70’s are now obsolete and the resultant renovation or demolition is uncovering hazardous materials and environmental challenges. New materials not addressed in the 1980’s and 90’s are now becoming regulated. Day-to-day contracting practices may yield environmental hazards; and these exposures are not restricted to environmental contractors.
